17. Harbert HARTON (1) was born in 1789 in Warren County, NC. He died in 1866 in Rutherford County, NC. The Will of Harbert Harton of Rutherford Co., NC was signed 31 Mar 1866. It follows the usual formula and appoints his two sons John Harton and Robert Harton executors to pay his just debts and funeral expenses. The he gives his beloved wife Elizabeth one half of all the land I now possess including the mantion house where I now live with all my cattle, hogs, waggons, farming tools, househole and kitching furniture of every descreption as long as her natural life shall exist and then all that I have willed to my beloved wife Elizabeth is to return to my beloved son James Harton by him careeing for and taking care of my beloved wife Elizabeth as long as she shall live. Thirdly I give and bequeath to my beloved son James Harton all the remaining half of all the land I now possess as well as all that are mentioned before that my beloved wife Elizabeth has her lifetime estate in. Fourthly I hold a note of hand on my beloved son Anslom Harton baring date twelve months after date the 26 July 1851 that I gave him all the principle and interest. Fifthly all the outstanding debts of every description when collected I mean those not heretofore mentioned shall be equally divided between all my children to wit John M. Harton A.M. HartonRobert H. Harton T. J. Harton Mary Ann Webber Sarah Jain Oats James H. Harton. Sixthly I gave to my son John M. Harton the capboard and bureau after the death of my beloved wife Elizabeth which my son James Harton is to have no claim to in the househole and kitchen furniture. Seventhly it is my will that my beloved wife Elizabeth have the disposing of all her beds and bed clothing to her own liking althou it has mentioned hereto fore for my beloved son James Harton to have all the household and kitchen furniture but now I leave that part to the disposal of my beloved wife Elizabeth Harton.
